Terms of Use

These Terms of Use ("Terms") govern your use of the Brushed app, website, and related services (collectively, the "Service"). By using Brushed, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Brushed. If you are under the age of majority in your jurisdiction, you must use Brushed with the involvement of a parent or legal guardian.

2. Use of the Service

Brushed is provided for personal, non-commercial use. You agree not to:

  • misuse or interfere with the Service
  • attempt to access systems or data you are not authorized to access
  • reverse engineer, copy, resell, or exploit the Service except as permitted by law
  • use Brushed in a way that violates applicable law or Apple platform rules

We grant you a limited, non-exclusive, non-transferable, revocable license to use Brushed for your personal use, subject to these Terms.

3. Accounts

Some features may be available without an account. Certain features, including backup, restore, or group functionality, may require you to link an account using Sign in with Apple.

You are responsible for maintaining access to your device and Apple account credentials. You are also responsible for activity that occurs through your account or linked access.

4. Subscriptions and Billing

Brushed may offer paid subscriptions.

If you purchase a subscription:

  • payment is charged through your Apple ID account
  • subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • your account will be charged for renewal within 24 hours before the end of the current billing period
  • you can manage or cancel your subscription through your Apple account settings after purchase

Pricing, trial availability, and subscription features may change from time to time where permitted by law.

If a free trial is offered and you purchase a subscription before the trial ends, any unused portion of the free trial may be forfeited.

5. Apple Terms

If you downloaded Brushed from the Apple App Store, you acknowledge that:

  • these Terms are between you and Brushed, not Apple
  • Apple is not responsible for the Service or its content
  • Apple has no obligation to provide maintenance or support services for the Service
  • Apple is a third-party beneficiary of these Terms and may enforce them against you

Your use of Brushed must also comply with any applicable App Store terms.

6. Health and Wellness Disclaimer

Brushed is intended as a habit-building and accountability tool. It is not medical, dental, or healthcare advice, and it is not a medical device.

Always use your own judgment and consult a qualified professional for medical or dental concerns.

8. Termination

We may suspend or terminate your access to Brushed if you violate these Terms, misuse the Service, or create risk or harm to us or other users.

You may stop using Brushed at any time. If you have an account, you may also request deletion through the app or by contacting us.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

We do not guarantee that:

  • the Service will always be available, uninterrupted, or error-free
  • the Service will meet all of your expectations
  • any particular results will be achieved through use of Brushed

10. Limitation of Liability

To the fullest extent permitted by law, Brushed and its affiliates, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, goodwill, or business opportunities arising out of or related to your use of the Service.

To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to Brushed for the Service in the 12 months before the event giving rise to the claim, or $50 USD, whichever is greater.

11. Changes to the Service or Terms

We may update the Service and these Terms from time to time. If we make material changes, we may provide notice through the app, website, or other reasonable means. Your continued use of Brushed after the updated Terms take effect means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws of Tennessee, United States, without regard to conflict of law principles, except where applicable law requires otherwise.
